Terms of Use
1. This Agreement may be amended by BCWF from time to time without specific advance notice to you. The latest Agreement will be posted on the Application, and you should review the Agreement prior to using the Application.
2. Editing, Deleting and Modification
BCWF reserves the right in its sole discretion to edit the Application, including any documents, information or other content appearing on the Application.
3. Compliance with Laws
You agree to comply with all applicable federal, provincial, and local laws, rules, and regulations, including but not limited to privacy laws or the laws of trespass. Without limiting the foregoing, you agree that you will not use the Application to a private property without permission, and will not otherwise engage in any activity that may result in injury, death, property damage, or liability of any kind. You understand and agree that you have no power to confront or apprehend violators beyond those of any other civilian. You are an extra set of eyes and ears for natural resource enforcement officers.
This application is not to be used to report wildlife or human-wildlife conflict.
4. Assumption of Risk
You agree that your use of the Application is at your own risk. You acknowledge that you are aware of the risks inherent in the use of the Application, including the possibility of physical injury, property damage, or other losses. You nevertheless freely and voluntarily assume these risks.
5. Limitation of Liability
IN NO EVENT SHALL BCWF OR ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS AND AGENTS (THE “BCWF PARTIES”) BE LIABLE WHATSOEVER FOR YOUR USE OF THE APPLICATION. IN PARTICULAR, BUT NOT AS A LIMITATION THEREOF, BCWF AND THE BCWF PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE NEGATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND BCWF. THE APPLICATION WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.
6. Disclaimer
BCWF PROVIDES THE APPLICATION “AS IS”, “AS AVAILABLE” AND ALL WARRANTIES, EXPRESS OR
IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE).
7. Indemnification
You agree to indemnify, defend and hold BCWF and the BCWF Parties harmless from any liability, loss, claim and expense, including reasonable legal fees, related to your violation of this Agreement or your use of the Application.
8. Use of Information
BCWF reserves the right, and you authorize BCWF, to the use and assignment of all information regarding your use of the Application and all information provided by you in any manner consistent with BCWF’s privacy policy.
9. Non-transferable
Your right to use the Application is not transferable. Any password or right given to you to obtain access is not transferable.
